Terms and Conditions (T&C)

1. Scope of Application

1.1 These general terms and conditions (hereinafter referred to as "GTC") apply to the use of the website jungkraut.ch as well as to all orders placed in online stores of Jungkraut AG, Baarerstrasse 2, 6300 Zug, Switzerland, +41 44 515 60 09, hello@jungkraut.com (hereinafter referred to as "Jungkraut AG").

1.2 By confirming the order, the customer is deemed to have accepted the T&C.

2. Offer and Conclusion of Contract

2.1 The presentation of the products in the jungkraut.ch online store does not constitute a legally binding offer, but an invitation to the customer to place a binding order (offer to conclude a contract).

2.2 By clicking on the "Buy"; "Buy now"; "Pay" button, the customer places a binding order for the products listed in his shopping cart.

2.3 Immediately after receipt of the order, the seller confirms the order by email. The contract is only concluded when the seller confirms the shipment of the goods by email (order or shipment confirmation) or at the latest by delivery of the goods. For non-physical goods, the purchase contract is valid immediately.

3. right of withdrawal

3.1 Customers have the right to return the goods during 30 days after delivery of the goods. The right of withdrawal is exercised by returning the goods, a reason is not required. The return must be sent to Jungkraut AG, Baarerstrasse 2, 6300 Zug, Switzerland. For the observance of the time limit, the date of dispatch of the revocation is decisive.

3.2 The exercise of the right of withdrawal leads to the conversion of the purchase contract into a return relationship, according to which the services received under the purchase contract must be refunded. The customer must send the goods with the original packaging to Jungkraut within 14 days after declaring the cancellation. Jungkraut AG bears the costs for the return shipment.
3.3 Upon timely receipt of the goods, any purchase price already paid will be promptly refunded to the customer.  

3.4 A deduction from the purchase price to be refunded or an invoice for possible damage, excessive wear and tear of the goods or, if agreed, costs of sending the goods to us shall remain reserved. No deduction will be made if the loss in value is due to handling of the goods that is necessary to determine the nature, condition and functionality of the goods. Jungkraut AG can refuse repayment until it has received the returned good or until the customer has provided proof that he has returned the goods, whichever is the earlier.

3.5 The right of return excludes the following products:

- personalized goods with individual elements.

4. price and shipping costs 

4.1 Unless otherwise stated, the prices quoted on the product page include VAT and other price components such as shipping costs or packaging and are in the currency indicated (CHF or EUR).

4.2 In addition to the stated prices, shipping costs may be incurred depending on the delivery address, quantity of goods and item. The exact shipping costs are displayed to the customer in the order process. No further costs are incurred for delivery within Switzerland.

4.3 For deliveries outside Switzerland or the European Union, additional costs for taxes and customs duties may apply. The laws and customs duties of the destination country of an order apply. It is possible that shipping service providers claim corresponding customs and duty fees directly from the customer upon receipt. These charges are the responsibility of the customer. They are not refundable by Jungkraut.

4.4 Jungkraut reserves the right to change its prices and offers at any time. Only the prices published on the website during the order process and on the order date are binding for customers.


5. delivery

5.1 Delivery is possible worldwide.

5.2 The delivery time for physical goods in Switzerland is normally 1-2 business days, in Europe 2-5 business days and in the rest of the world 4-20 business days. This applies unless otherwise stated in the order process. If a longer delivery time is necessary, the customer will be informed by e-mail after this time. If the customer has not received an e-mail, he may withdraw from the purchase contract.

5.3 If not all ordered products are in stock, Jungkraut AG is entitled to make partial deliveries. The customer will not incur any additional costs due to partial deliveries.

5.4 If the delivery of the goods is not possible after two delivery attempts, Jungkraut AG can withdraw from the contract. Payments made will be refunded to the customer.

6. terms of payment

6.1 Payment has to be made by the customer either PayPal  or credit card. The debit of the means of payment takes place at the time of the order.

6.2 Offsetting with counterclaims of the customer that are not recognized or not legally established is excluded.

6.3 The customer may only exercise a right of retention insofar as the claims are based on the same contractual relationship.


7. retention of ownership 

The goods remain property of Jungkraut AG until full payment has been received.


8. warranty  

8.1 Jungkraut AG provides warranty by remedying defects. This shall be done at its discretion by subsequent performance, namely elimination of a defect (rectification) or delivery of a defect-free item (replacement).

8.2 If the subsequent performance fails, the customer shall be entitled to withdraw from the contract. This shall not apply to insignificant defects. A right of the customer to a reduction is excluded.

9. Liability 

Jungkraut AG excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by auxiliary persons and substitutes, namely these are hosting and payment providers.

11. Jurisdiction and Applicable Law 

11.1 The purchase contract between the customer and Jungkraut is subject to Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980.

11.2 The place of jurisdiction is Zug, Switzerland.


12. final provisions

Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.
