Terms and Conditions (T&C)
1. Scope of Application

1.1 These terms and conditions (hereinafter referred to as “T&C”) apply to the use of the website jungkraut.com as well as to all orders placed in online stores of Jungkraut AG, Baarerstrasse 2, 6300 Zug, Switzerland (hereinafter referred to as “Jungkraut”).

1.2 By confirming the order, the customer is deemed to have accepted the T&C.

2. Offer and Conclusion of Contract

2.1 The products presented in the online stores do not constitute a legally binding offer but are an invitation to order.

2.2 By clicking on the “Buy”; “Buy now”; “Pay” button, the customer places a binding order for the products listed in his shopping cart.

2.3 After the order, Jungkraut will immediately send a confirmation of the order by email. In case of physical goods, the purchase contract is concluded upon delivery of the goods. In case of non-physical goods the purchase contract is valid immediately.

3. Prices

3.1 Unless otherwise stated, the prices indicated on the website are exclusive of VAT and other price components such as postage or packaging. Furthermore, the prices are in the currency indicated (Swiss francs or euros). The exact costs for shipping and other additional services will be indicated to the customer in the order process.

3.2 For deliveries outside of Switzerland or the European Union, additional costs for taxes and customs duties may apply. The laws and customs duties of the destination country of an order apply. It is possible that shipping service providers claim corresponding customs and duty fees directly from the customer upon receipt. These charges are the responsibility of the customer. They are not refundable by Jungkraut.

3.3 Jungkraut reserves the right to change its prices and offer quantities at any time. Only the prices published on the website during the order process and on the order date are binding for customers.

4. Delivery

4.1 Jungkraut delivers orders worldwide.

4.2 The delivery time for physical goods in Switzerland is normally 1-3 business days, in Europe 2-5 business days and in the rest of the world 4-20 business days. This applies unless otherwise stated in the order process. If a longer delivery time is necessary, the customer will be informed by email after this time. If the customer has not received an email, he may withdraw from the purchase contract

4.3 If not all products are in stock, Jungkraut is entitled to send individual products in partial deliveries.

4.4 If delivery of the goods is not possible after two delivery attempts, Jungkraut may withdraw from the contract. Payments made will be refunded to the customer.

5. Terms of Payment

5.1 Payment is made either by Twint, PayPal or credit card. The debit of the means of payment takes place at the time of the order.

5.2 Offsetting with counterclaims of the customer that are not recognized or not legally binding is excluded.

5.3 A right to retain goods is only applicable insofar as the claims are based on the same purchase contract.

6. Retention of Ownership

The goods remain property of Jungkraut until full payment.

7. Right of Withdrawal

7.1 Customers have the right to revoke the contract within 14 days after receipt of the goods. The revocation must be made in writing by e-mail or the appropriate form on the website. For the observance of the deadline, the time of dispatch of the revocation is decisive.

7.2 Exercising the right of revocation results in the purchase contract being converted into a rescission relationship. The goods received under the purchase contract must be returned. The customer must send the goods with the original packaging to Jungkraut within 14 days after declaring the revocation. The customer bears the costs for the return shipment, unless otherwise stated.

7.3 After timely receipt of the goods, the purchase price will be refunded to the customer within 14 working days. Any deductions from the purchase price for possible damage to the goods are reserved. Jungkraut can refuse a refund until the goods have been received back or until the customer can credibly prove that he has returned the goods.

7.4 The right of withdrawal is excluded for personalized goods like individual refinements.

8. Warranty and Liability

8.1 Jungkraut warrants that the goods comply with the warranted characteristics, do not have any defects affecting their value or suitability for the intended use and comply with the prescribed services and specifications. Jungkraut reserves the right to remedy an existing defect by repair or replacement or to deliver a defect-free item.

8.2 The buyer is obliged to check the goods immediately after receipt and to report defects.

8.3 If rectification or replacement cannot be provided, the customer shall be entitled to withdraw from the contract. However, this shall not apply to insignificant defects. The customer shall not be entitled to a reduction in price.

9. Liability

Jungkraut excludes liability for slightly negligent breaches of contract. Jungkraut is also not liable for defects which are not in its area of responsibility and of services which are provided by third parties. Namely, these are hosting and payment providers.

10. Jurisdiction and Applicable Law

10.1 The purchase contract between the customer and Jungkraut is subject to Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980.

10.2 The place of jurisdiction is Zug, Switzerland.

11. Final Provisions

If parts of these terms and conditions should be invalid, this shall not affect the validity of the remaining provisions. Instead of the invalid provisions, the relevant legal provisions shall apply mutatis mutandis.
